DUI & RecklessDriving ArrestsFAQ

What should I do immediately after being arrested for DUI or reckless driving?

Following your arrest, it is essential to remain silent and refrain from discussing the incident with anyone except your attorney. Even if you have already provided information to law enforcement, obtaining legal representation is critical. You have only 10 days from the date of your arrest to request a DMV hearing to protect your driving privileges. It is also important to note that while refusing a chemical test may seem like an option, doing so after being properly advised can result in a one-year suspension of your license. Contact the Law Offices of Ty Martinez promptly to ensure your rights are protected and navigate these crucial steps.

How long will my driver's license be suspended after a DUI or reckless driving charge?

The length of your driver’s license suspension depends on several factors, including the severity of the offense, your prior driving history, and whether you were charged with DUI or reckless driving. You may be able to challenge the suspension at a DMV hearing, but this request must be made within 10 days of your arrest. Our firm will guide you through this process to preserve your driving privileges whenever possible.

What are the financial costs associated with a DUI or reckless driving conviction?

In addition to legal fines, a conviction may lead to increased insurance premiums, mandatory court fees, costs associated with educational programs, and potential loss of employment. At the Law Offices of Ty Martinez, we focus on reducing these financial burdens by providing a robust defense and exploring all available legal avenues.

Are there alternatives to jail time for DUI or reckless driving convictions?

Yes, alternatives to incarceration may be available, including probation, work release, house arrest, community service, or participation in driving safety courses. These alternatives depend on the specific circumstances of your case and your prior criminal record. Our attorneys will negotiate to pursue these options, aiming to reduce the overall impact on your life.

Can I challenge a DUI or reckless driving charge if I failed a sobriety test?

Yes, sobriety tests, including breathalyzer and field sobriety tests, can be contested. Factors such as the reliability of the testing devices and the conditions under which the tests were administered can be questioned. Our attorneys are well-versed in challenging the validity of these tests and will examine the procedures followed during your arrest to strengthen your defense.

What impact could a DUI or reckless driving conviction have on my future?

A conviction for DUI or reckless driving can have serious, long-term consequences, including damage to your criminal record, loss of driving privileges, and diminished career prospects. It is crucial to approach these charges with the help of experienced legal counsel. Our firm will vigorously defend your case to protect your future and minimize the potential consequences of a conviction.

Your license is a separate case

A DUI arrest starts two cases: the criminal case in court and a license suspension case at the DMV. The temporary license the officer gives you is good for 30 days. In most cases you have only 10 days from your arrest to request a DMV hearing. If no one asks for one, the suspension takes effect when the temporary license runs out. Call us right away so that deadline does not pass.

I truly can’t recommend Ty Martinez enough. He helped me through my DUI and hit-and-run case during one of the most stressful and overwhelming times in my life, and I’m incredibly grateful that I had him representing me. From the beginning, Ty made me feel like I had someone genuinely fighting for me and looking out for my best interest. He was professional, knowledgeable, patient, and made sure I understood what was happening throughout the entire process. Having someone I could trust made such a huge difference. Ty helped me more than I could have ever expected, and I’m extremely grateful for everything he did for me and for the outcome of my case. He made a situation that felt terrifying and uncertain so much easier to get through. If you’re going through a difficult legal situation and need someone you can trust to have your back, I highly recommend Ty Martinez. I found my self in a situation that I never thought I would. I found Ty and reached out. Saw the reviews and awards so I figured I’d do a consultation. Ty listened intently, asked questions, and was very straightforward. Didn’t sugarcoat anything. Gave me my options and I felt comfortable. Ty always got back to me. Even if he was busy, he’d let me know when to expect a callback. He fought like hell for me and I was able to resolve my issue. I won’t ever need this type of help again but if you do need help, I recommend reaching out to Ty.

My husband and I contacted Ty’s office to ask a few questions, not sure if they could help us. Ty went above and beyond to not only answer those questions but give us information, even though we ended up not needing his services. His number will always be with us in case we need anything. Can’t recommend enough.

Mr. Martinez was recommended by a friend. He not only took on my case and handled everything with careful tact and professionalism but he also cares.
